First of all, it’s terribly unsafe. Unfortunately, it’s becoming much more common in the state of Florida and every other state in this country. Number one, don’t do it. If you happen to be the victim of an accident where someone has crashed into you because they were texting, they are legally responsible in the state of Florida and they may be responsible for not just your compensatory damages, but also for punitive damages. The type of damages to punish them for their conduct in deciding to text while driving a motor vehicle.
