It depends. If a jury were to find you 100% at fault for causing the accident, then the answer is no, you couldn’t make a recovery. There would be no claim to be made. The jury wouldn’t award you any monetary damages for your losses, injuries, and damages. However, Florida is a comparative negligence state. We’re not a contributory negligence state. If the case were tried in front of a jury and a jury found you 50% at fault, and the other motorist involved in the accident 50% at fault, you could make a recovery for 50% of your damages. For example, if you’re found 1% at fault, and the defendant 99% at fault, only 1% of your damages would be reduced on the final judgment.
